The Terms and Conditions of Use (“Agreement”) for Salaam Soulmates, a matchmaking platform operated by Quantuva Technologies, specifically designed for the Muslim community in India. This Agreement is published in compliance with Rule 3(1) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021. The platform facilitates matrimonial alliances in accordance with Islamic laws as practiced in India. By accessing or using this Platform, you agree to abide by these terms.

Access to the Platform is free. However, we offer Premium Memberships wherein one can promote his/her profile on various properties such as premium interest wall, inbox, search results, emails, SMS, video chat etc.

1. Acceptance of Terms

1.1. By registering or using Salaam Soulmates ("Platform"), you agree to be legally bound by this Agreement. If you do not accept these terms, you must refrain from using the Platform.  

1.2. You consent to the collection, processing, and use of your personal data, including sensitive information such as financial data or identity proofs, to facilitate the matchmaking process. Should you object to the collection and processing of your personal data, you are advised not to register with the Platform.  

1.3. You may withdraw consent at any time by discontinuing your use of the Platform and deleting your account.  

2. Eligibility  

2.1. To use the Platform, you must be a Muslim, as defined under Muslim Personal Law, and of legal marriageable age as prescribed by Indian law (currently 18 years for females and 21 years for males). 

2.2. The Platform is strictly for the purpose of facilitating lawful Muslim marriages as per the Muslim Personal Law (Shariat) Application Act, 1937, and related statutes applicable in India.

2.3. By registering, you warrant that you are eligible for marriage under the applicable laws, and you intend to use the Platform solely for matrimonial purposes and not for casual dating or commercial activities.

2.4. Salaam Soulmates reserves the right to terminate your membership without notice if it has reason to believe that you are not eligible under the law, have misrepresented your profile, or have violated this Agreement.

3. Account Security  

3.1. You are responsible for maintaining the confidentiality of your login credentials. You agree to immediately notify Platform of any unauthorized use of your account or any other security breach.

3.2. The Platform shall not be liable for any loss or damage arising from unauthorized use of your account due to your failure to secure your credentials.

4. Term and Termination

4.1. This Agreement remains in effect as long as you continue to use the Platform.  

4.2. You may terminate your membership at any time by deleting your profile. Upon termination, no refund of any subscription fees paid shall be issued.  

4.3. Salaam Soulmates reserves the right to terminate your access to the Platform without notice if you breach this Agreement, engage in inappropriate behaviour, or use the Platform for purposes other than lawful matrimonial alliances under Muslim law.

4.4. Certain provisions of this Agreement including sections 4 to 7 and sections 9 to 12, shall remain effective even on termination.

4.5. Term for the paid Membership would be in accordance with the type of membership undertaken.

4.6. In the event of business discontinuity, the Platform shall refund 50% of the unused membership fees paid by you.

5. Non-Commercial Use

5.1. The Platform is intended solely for personal use by individual members seeking matrimonial alliances in compliance with Islamic laws. It must not be used for any commercial purposes, including advertising or promoting any products or services.  

5.2. Any unauthorized commercial use or unlawful activity will result in immediate termination of membership and may subject the user to investigation, and appropriate legal action, including but not limited to, civil, criminal, and injunctive redress.

6. Compliance with Muslim Personal Law

6.1. All matrimonial alliances facilitated through Salaam Soulmates must conform to the provisions of Muslim Personal Law as practiced in India.  

6.2. Polygamy is permissible under Muslim Personal Law, subject to the conditions set forth in the Shariat. Members intending to enter into polygamous marriages must clearly disclose their marital status.  

6.3. The Platform strictly caters to Muslims seeking marriage within the framework of Islamic law. Non-Muslims or users seeking interfaith marriages are not eligible to register.

7. Member Conduct and Responsibilities

7.1. Salaam Soulmates reserves the right, at its sole discretion, to monitor and review the activity and status of each member account. Based on such review, the Platform may, without prior notice, block access to any member account found to be in violation of this Agreement or engaged in inappropriate behavior.

7.2. Salaam Soulmates further reserves the right, at its sole discretion, to restrict or suspend access to its Platform based on the review of the member's activity, status, or any other criteria deemed appropriate by the Platform. The member will be duly notified of any such action.

7.3. By registering as a member, you confirm that you consent to receiving communications via email, SMS, WhatsApp messages, and phone calls from Salaam Soulmates and its members. This includes SMS messages for mobile verification, transaction authentication via OTP, as well as communications related to matchmaking services, promotions, and inquiries. This consent remains valid as long as you are a registered member.

7.4. Members are prohibited from creating multiple profiles. Salaam Soulmates reserves the right to deactivate any or all duplicate profiles without refund of any subscription fees paid.

7.5. You confirm that all information provided, including personal details, is accurate and truthful. If you are creating a profile on behalf of a third party (e.g., a sibling, child, or friend), you hereby confirm that you have obtained the necessary consent from the individual whose profile you are creating. Impersonation is a criminal offense and is punishable under relevant laws.

7.6. Members are strongly encouraged to submit a copy of their Driving License, Passport, or other government-issued identification in order to add a trust badge to their profile. This step is advised to enhance trust and authenticity.

7.7. Members are prohibited from using the Platform to promote, advertise, or solicit the sale of products or services to other members, except for the purpose of promoting their profile for matrimonial purposes.

7.8. You agree not to send chain letters, junk emails, or unsolicited messages to other members. While Salaam Soulmates cannot monitor or control interactions that occur outside the Platform, any use of information obtained from the Platform to harass, abuse, harm, or engage in unsolicited advertising or solicitation is strictly prohibited. Salaam Soulmates disclaims any liability for actions or communications that occur outside of its Platform.

7.9. Salaam Soulmates reserves the right to take necessary actions, at its sole discretion, to protect itself and its members from any form of abuse, misuse, or inappropriate conduct.

7.10. Members agree not to use the Platform to harass, intimidate, or harm other members. Any such conduct will result in immediate termination of membership without refund.

7.11. Members are expected to interact with others in a respectful manner and adhere to Islamic principles of modesty. You agree to be decently dressed during any events or meetings facilitated through the Platform.

7.12. You are prohibited from using any automated processes, such as IRC Bots, EXE’s, CGI scripts, or other programs/scripts, to access or interact with the Platform or its members.

7.13. Salaam Soulmates reserves the right to monitor and screen communications and advertisements between members. Any communication deemed unwarranted, obscene, or inappropriate may be deleted by the Platform without prior notice.

7.14. Members are required to take reasonable precautions to safeguard their personal privacy and safety. By registering on the Platform, you expressly agree to review, comply with, and adhere to the safety guidelines provided by Salaam Soulmates.

8. Privacy and Content

8.1. You are required to provide accurate and truthful information during registration. Salaam Soulmates reserves the right to request verification of identity, including the submission of official documents such as Aadhaar or Passport.  

8.2. The Platform may remove any content deemed inappropriate or in violation of Islamic values or community standards. Repeated violations may result in the termination of your membership.  

8.3. By submitting your profile or success stories, you grant Salaam Soulmates permission to use your content for promotional purposes, subject to applicable privacy laws.

8.4. By submitting Content for inclusion on publicly accessible areas of the Platform, including profile details and success stories, you grant Salaam Soulmates an irrevocable, non-exclusive, royalty-free, worldwide license to use, store, reproduce, modify, adapt, publish, display, distribute, and create derivative works from such Content. This includes the right to display such Content to members of Salaam Soulmates.

8.5. You understand and agree that you are solely responsible for the accuracy and authenticity of the Content you post on the Platform. Salaam Soulmates does not control or guarantee the accuracy of Content posted by members. You agree to verify information independently before relying on it for any decision or action.

8.6. Salaam Soulmates reserves the right to verify the authenticity of Content posted on the Platform. You may be required to provide documentary or other forms of evidence to support the accuracy of the information you post. Failure to comply with such requests may result in the termination of your membership without refund.

8.7. The following is an indicative list of the kind of Content that is illegal or prohibited on the Platform. Salaam Soulmates will investigate and take appropriate legal action at its sole discretion against anyone who violates this Agreement, including but not limited to, removing the offending communication/Content from the Service and terminating the membership of such violators without a refund. Illegal and prohibited Content includes, but is not limited to, Content that:

a) Is blatantly offensive to the community, such as Content that promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual;

b) Harasses or advocates harassment of another person;

c) Involves the transmission of "junk mail," "chain letters," unsolicited mass mailings, or "spamming";

d) Promotes information that you know is false, misleading, or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory, or libelous;

e) Promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;

f) Contains restricted or password-only access pages, or hidden pages or images (those not linked to or from another accessible page);

g) Displays pornographic or sexually explicit material of any kind;

h) Provides material that exploits people under the age of 18 in a sexual or violent manner or solicits personal information from anyone under 18;

i) Provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;

j) Solicits passwords or personal identifying information for commercial or unlawful purposes from other users;

k) Engages in commercial activities and/or sales without our prior written consent, such as contests, sweepstakes, barter, advertising, or pyramid schemes;

l) Threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign states, or public order, or causes incitement to the commission of any cognizable offense or prevents investigation of any offense or is insulting to any other nation;

m) Impersonates another person;

n) Deceives or misleads the addressee about the origin of such messages or communicates any information that is grossly offensive or menacing in nature;

o) Must be in compliance with any and all applicable local, state, and federal laws, rules, and regulations;

p) Strictly prohibits the inclusion of any telephone numbers, street addresses, URLs, or email addresses in your Member profile that are visible to other Members.

8.8. You are strictly prohibited from soliciting passwords, financial details, or other personal identifying information for unlawful purposes.

8.9. All Content posted must comply with applicable local, state, and federal laws, including the laws governing matrimonial practices under the Muslim Personal Law.

9. Proprietary Rights

All content, software, and proprietary materials on the Platform are owned by Salaam Soulmates or its licensors. Unauthorized use, reproduction, or distribution of any materials without prior written consent is strictly prohibited and may result in legal action.

10. Limitation of Liability

10.1 . Salaam Soulmates shall not be liable for any indirect, consequential, incidental, or punitive damages arising from the use or inability to use the Platform, even if advised of the possibility of such damages.  

10.2 The liability of Salaam Soulmates, if any, shall be limited to the amount of fees paid by you for the service during the term of your membership.

11. Jurisdiction 

All disputes arising out of or in connection with the use of the Platform shall be governed by the laws of India, specifically Muslim Personal Law, and shall be subject to the exclusive jurisdiction of the competent courts in Telangana, India.

12. Indemnity

You agree to indemnify and hold harmless Salaam Soulmates, its officers, directors, agents, affiliates, and employees from any claim or demand, including reasonable attorney’s fees, arising from your use of the Platform or violation of this Agreement.

13. Modifications and Amendments

Salaam Soulmates reserves the right to modify or amend this Agreement at any time without prior notice. By continuing to use the Platform after such modifications, you agree to be bound by the revised terms.

14. Miscellaneous  

14.1. This Agreement constitutes the entire understanding between you and Salaam Soulmates regarding the use of the Platform.

14.2. If any provision of this Agreement is found to be invalid or unenforceable, the remainder of the Agreement shall remain in full force and effect. 

14.3. By becoming a Member of Salaam Soulmates, you agree to receive certain specific emails, messages, and communications from the Platform or its affiliated websites. These communications may include, but are not limited to, notifications regarding your account, potential matches, advertisements, promotional offers, and updates related to the services offered by Salaam Soulmates. You can unsubscribe from promotional emails at any time by following the unsubscribe instructions included in such communications.

14.4. This Agreement is an electronic document in accordance with the Information Technology Act, 2000, and the rules thereunder as applicable and amended. This electronic record is generated by a computer system and does not require any physical or digital signatures.
